General Conditions of Use

ARTICLE 1 : PREAMBULE The present general terms apply exclusively between : - the SARL La FEDE (limited liability company), which capital amounts 1200 Euros, is registered at the Registre du Commerce et des Sociétés de Nanterre under the number 483 963 658 R.C.S situated 791, avenue du Général Leclerc 92100 Boulogne Billancourt FRANCE And - any private user buying online a product or service through a website edited by the company La FEDE may amend at any time the present general terms, terms applicable to the customer are the ones in force at the time of subscription to the service ARTICLE 2 : PRODUCTS AND SERVICES Products and services concerned by the following general terms are displayed on the website http://www.la-fede.net and its affiliates. Registration of a new user to one of the available services entails effectively acceptance of the general terms. ARTICLE 3 : CONDITIONS Of ACCESS TO SERVICES The use of the services and performances of La Fédé may be put to an end temporarily or permanently at any time on the user's initiative under conditions stated on the website http://www.la-fede.net and its affiliates. The user renounces in this case to any claim for damages or refund in Classy Funds (CF) by LA FEDE. Persuant to the rules stated on the website http://www.la-fede.net, temporary or definite closure of an account may be effectuated at any time on LA FEDE's initiative if the user was to be bankrupt for a long period (in the event of lack of funds). Removal of an account (entirely or in parts) may be carried out at any time on LA FEDE's initiative without damages if it is manifest that the user's conduct has been illegal or in breach of the game's rules. In the event of the removal of an account for any reason independent to La Fédé's intent, payment or refund of unused CF cannot be demanded by the user. It can be proceeded constantly, on the initiative of the user, with the final or temporary stop of the use of the services and services of LA FEDE, according to posted conditions on the site http://www.la-fede.net or its affiliated sites. The user gives up in this case any compensation or refunding of Federal Credit (CF) on behalf of LA FEDE. He can be proceeded constantly, on the initiative of LA FEDE, with the temporary or final closing of the account of the user who would be in prolonged debtor situation (deprives appropriations), in accordance with the rules exposed on the site http://www.la-fede.net. He can be proceeded constantly, on the initiative of LA FEDE and without compensation, with the suppression of whole or part of the account of the user who would have obviously proceeded to illicit or contrary actions with the rules of a play. In the event of suppression of an account for any reason independent of the will of FEdE, the CF not consumed by the player could not be claimed or refunded. ARTICLE 4 : AVAILABILITY OF THE SERVICE LA FEDE shall not be held liable for any difficulty to access the website or temporary impossibility of access caused by network disturbances or by restrictions imposed by the server host. LA FEDE shall not be held liable for the poor performance or unavailability of the service on a given internet browser. LA FEDE does not provide warranties as to the complete inexistence of bugs nor that faults brought to its attention will be fixed. No claim relying on these matters shall be accepted. Moreover, LA FEDE shall not be held liable for direct or indirect consequences of bugs of any kind or damages that would affect the user. The user is entitled to an appropriate means of access and use of LA FEDE's services. LA FEDE has a right to put temporarily on hold access to one or several of its websites for maintenance purposes and/or updates. This does not entitle the user to damages. ARTICLE 5 : PAYMENT The means of payment placed at the disposal of the user by the FEDE are : - Bank check with the order of LA FEDE - Bank card or surtaxed phone call. These means of payment are entirely managed by technology ALLOPASS of Frog Planet and PAYPAL, ensured by PayPal Europe Limited, which act like third of confidence. No moment, the number of bank card forwards on our waiter. The user is only responsible for the use of the means of payment suggested by LA FEDE. He guarantees for this reason that he lays out many rights of user of these means (blue chart, cheque book, bank account). The transactions carried out by cheque and credit transfer are regarded as effective only as from the moment when they are delivered and validated by LA LA FEDE. In the event of missing information (identification number LA FEDE, name of user), it could not be taken action on the transaction. LA FEDE reserves the right to suspend any account credited by means of a means of fraudulent payment, or in the event of negative continuation data with the payment by the accredited banking authorities. Any payment carried out by the user is irrevocable. Sponsorship : The holder of active a Fédé account wishing to carry out the promotion of Fédé or one of his plays can be rewarded by gifts for CF thanks to the system for sponsorship. All new player recruited by the care of another user can choose this last like "godfather". This godfather will perceive a percentage of free CF proportional to the expenditure of his godson. To in no case the holder of a Fédé account will not be able to assert the sponsorship of another account without the agreement of this last. A player can take the step to declare a godfather only at the time of his inscription. Any request on a purely retroactive basis will be rejected. ARTICLE 6 : PRICE OF THE SERVICES AND SERVICES The prices of the products or services suggested by LA FEDE are those in force at the time of the command sent by the user and consultable on the affiliated site http://www.la-fede.net and its sites. They are expressed in Euros and mean all inclusive of tax. The cost of the services of LA FEDEis output according to the services in a way daily, weekly, monthly, or any other period defined by LA FEDE, in the form of a fixed price deduced from the account of CF of the user, independently of his utilisation period of the product or service. ARTICLE 7 : RIGHT OF RETRACTATION In accordance with the L.121-20 article of the Code of consumption (France), in the event of subscription with the remote Service and in particular by electronic way, the user has a 7 days deadline wrought to retract as from the acceptance of the offer of subscription for the Service, by sending a postal mail recommended to LA FEDE. However, pursuant to the article L. 121-20-2 of the same code, the Customer is informed that if it uses the Service before the expiry of the 7 days period, it does not lay out any more this right of retractation. ARTICLE 8 : RESPONSIBILITY The user declares and recognizes that all information, data, texts, images, bonds, or all other materials (hereafter collectively called "Contents") which they are made available of the public or transmitted in a private way, are under the only responsibility for the person having emitted these Contents. The user is only responsible for the Contents which it posts, downloads or transmits in any other manner via the Services of the LA FÉDÉ. In all assumptions, LA FÉDÉ will not be able to in no case to be held for person in charge in particular for the Contents, error or omission in very Contenu, any loss or damage consecutive with the use of very Contenu posted, transmitted by any means via its services, but begins to withdraw them as soon as possible in the event of dispute, expressed at LA FÉDÉ. ARTICLE 9 : ROYALTIES The texts, the logos, the elements graphic, sound and visual, their presentation and their assembly which are reproduced on this site or the affiliated sites are the exclusive property of LA FÉDÉ or their respective and, by way of works and marks of trade, recorded holders or not, are protected by the unit from the French and international legislation relating to the intellectual property. Any loading, retransmission, copy or unauthorized modification of the data contained on the site can thus contravene these rules and could expose the responsible user, and all people, with the penal and civil sorrows envisaged by the law. He will have for this purpose to contact LA FÉDÉ. ARTICLE 11 : APPLICABLE LAW The general conditions of sale hereby stated are subject to french law. Any dispute relating to commercial relationships existing between LA FEDE SARL and the user would in the impossiblity of an amicable settlement fall under the jurisdiction of the Tribunal Commercial de Nanterre (Nanterre Commercial Court) for the company is registered in its area of jurisdiction.
